This policy governs the terms under which a project, service, or agreement with Avotix may be cancelled by either party. Please read carefully before engaging our services.
Once a project has been initiated and work has commenced, cancellation by the client is not encouraged and may result in financial implications. All projects require upfront planning, allocation of resources, and dedicated effort from our team.
In the event that the client requests cancellation after partial or significant progress has been made, Avotix reserves the right to charge for all work completed up to the date of cancellation. This includes, but is not limited to, planning, design, development, consultations, and any other services rendered.
The client shall be responsible for clearing all outstanding dues before the cancellation process is finalized. Any unpaid balance may result in withholding of work, deliverables, or legal recovery actions if necessary.
Cancellation charges are calculated based on the stage of the project at the time of the request:
Cancellation requests must be submitted in writing through an official communication channel, such as email, to be considered valid. Verbal or informal requests will not be accepted as confirmation of cancellation.
Upon receiving a valid written request, Avotix will review the status of the project and determine the applicable charges based on the work completed and resources utilized.
If a project is cancelled due to prolonged inactivity from the client's side — including failure to provide necessary inputs, approvals, or communication for an extended period — Avotix reserves the right to treat the project as abandoned.
Avotix also reserves the right to cancel or terminate a project at its discretion under certain circumstances, including but not limited to:
In such cases, the client shall not be entitled to any refund for payments already made, and Avotix shall not be held liable for any losses resulting from such termination.
For milestone-based projects, cancellation after the completion of any milestone will not affect the payments already made for that milestone. Each completed milestone is considered final, and the corresponding payment is non-refundable.
If cancellation occurs between milestones, charges will be calculated based on the work completed up to that point in the current phase.
For international clients, any applicable refunds (if approved under exceptional circumstances) will be processed in the original payment currency. All transaction fees, currency conversion charges, and banking costs associated with the cancellation or refund process shall be borne entirely by the client.
Avotix shall not be responsible for any financial loss due to exchange rate fluctuations or third-party payment systems.
No cancellation shall entitle the client to claim ownership of incomplete, unpaid, or partially delivered work. All such work remains the property of Avotix until full payment has been made as per the agreed terms.
For full details, please review our Intellectual Property Policy and Refund Policy.
In the event of any dispute related to cancellation, both parties agree to first attempt resolution through mutual discussion and good faith negotiation. This Cancellation Policy shall be governed by and interpreted in accordance with the laws of India, and any disputes arising shall be subject to the exclusive jurisdiction of the courts located in Meerut, Uttar Pradesh, India.
Avotix reserves the right to modify or update this Cancellation Policy at any time without prior notice. By engaging with Avotix and initiating any project or service, you confirm that you fully understand and agree to this Cancellation Policy.
